FUNCTIONS OF THE SANGGUNIANG BAYAN
Pursuant to Republic Act 7160 otherwise known as the Local Government Code of 1991 and the approved Rules of Procedure, the members of the Sanggunian Bayan of Tigaon, Camarines Sur shall assume office on the day and in the manner provided for by law, duly elected and qualified. They shall, on the day and time fixed by ordinance, meet at the designated place for the holding of the session of the Sanggunian and proceed to do business forthwith.
The Sanggunian Bayan of Tigaon, Camarines Sur shall discipline its members for disorderly behavior and absence without justifiable cause for four (4) consecutive sessions, for which they may be censored, reprimanded, or excluded from the session, suspended for not more than sixty (60) days, or expelled; Provided, that the penalty of suspension or expulsion shall require the concurrence of at least two-third (2/3) votes of all the Sangguniang Members; Provided further, that a member convicted by final judgment to imprisonment of at least one (1) year for any crime involving moral turpitude shall be automatically expelled from the Sanggunian.
Every member shall be present in the session hall of the Sanggunian Bayan of Tigaon during its session unless expressly excused by it or necessarily prevented from doing so by reason of sickness or other unavoidable circumstances duly reported to the Sanggunian, through the presiding officer or the secretary.
Every member shall participate in the exercise of the power vested in, and in performing the duties imposed upon, the Sanggunian as a deliberative and collegial body, and shall represent the interest of the people of the entire municipality.
Every member present at a session shall vote on every question presented unless he has a direct personal or pecuniary interest therein.
All Sangguniang Bayan Members of Tigaon shall attend all regular sessions in formal attire; preferably dark-colored pants and barong or polo barong, or any uniform as may be collectively agreed upon by the council members.
The Vice Mayor shall be the Presiding Officer of the Sanggunian Bayan of Tigaon and, as such, shall have the following powers and duties:
a. To preside over the session of the Sanggunian Bayan of Tigaon, Camarines Sur;
b. To preserve order and decorum during the session and to exact from all present due respect and proper deportment, prevent disturbance and disorder, and to order the session hall cleared of any or all persons behaving improperly;
c. To decide all question of order, subject to appeal by the members;
d. To sign all ordinances, resolutions, orders proceedings and warrants issued by the order of the Sanggunian Bayan of Tigaon;
e. To declare the meeting adjourned to some other time or place in case of serious disorder or great emergency;
f. To sign all warrants drawn on the municipal treasury for all expenditures appropriated for the operation of the Sangguniang Bayan of Tigaon;
g. Subject to civil service law, rules and regulations, appoint all officials and employees of the Sangguniang Bayan of Tigaon.
The Presiding Officer shall assist in the expediting the business of the Sanggunian Bayan of Tigaon and shall, for this purpose, be permitted to make brief remarks on matter pertaining to pending debatable questions without expressing himself for or against said question. If the presiding officer intends to exhaustively participate in the deliberation on any pending question on the floor, he/she may temporarily relinquish the chair for the purpose.
As Presiding Officer, the Vice Mayor is entitled to vote, but only to break a tie. He may not, however, be compelled to vote.
The Sanggunian Bayan of Tigaon shall elect from themselves a deputy presiding officer who, without losing his status and prerogatives of a regular member shall temporarily exercise the powers and functions of the presiding officer when the latter is absent or is temporarily incapacitated.
In case the regular presiding officer and the deputy presiding officer are absent or temporarily incapacitated, the present members, constituting a quorum, shall elect from among themselves a temporarily presiding officer for the present session.
There shall be a Secretary of the Sanggunian Bayan of Tigaon. He shall keep his office in the building where the Sanggunian meets of at some other convenient place as the Sanggunian Bayan of Tigaon may direct. His duties shall be as follows:
a. To attend the session of the Sanggunian Bayan of Tigaon and to keep a record of its proceedings;
b. To call the roll of members, read the calendar of business and the minutes of the preceding session, by himself or through a reader designated by the presiding officer, to read the proposed ordinances and resolutions, messages, communications, memories, petitions, and other documents which he should report to the body or the reading of which is required by the Sanggunian or ordered by the presiding officer;
c. To record and number all ordinances and resolutions passed by the Sanggunian Bayan of Tigaon with date of the passage and publication of the same;
d. To affix the corporate seal to all ordinances and the official acts of the Sanggunian Bayan of Tigaon and certify to the approval of all acts duly approved by it;
e. To transmit to the proper committee matters referred to them by the Sanggunian Bayan of Tigaon or the presiding officer;
f. To notify the committees of their appointment or creation;
g. To send out appropriate notices of all called sessions and public hearings;
h. To keep in proper file all records and documents of the Sanggunian Bayan of Tigaon for which provisions are not otherwise made;
i. To translate or cause to be translated into the dialect generally spoken in the municipality all ordinances immediately after their approval by the Sanggunian and to have posted at the main entrance of the municipal building and in other conspicuous places in town;
j. To forward to the Sangguniang Panlalawigan, under the direction of the Vice Mayor, a copy of such approved ordinances and resolutions in the manner provided for by law; and
k. To provide, upon request, a Sangguniang Bayan Member with a copy of approved ordinances or resolutions or other documents which may be needed in line with the performance of his/her official function.
